Fair use in Punk rock

This is a sound sample from a commercial recording. Its inclusion here is claimed as fair use because:

  • It illustrates an educational article that specifically discusses the source band's central role in the development of the subject genre's hardcore subgenre, as discussed in the accompanying text;
  • It is a low-bit-rate sample of about 30 seconds from a much longer recording, and could not be used as a substitute for the original commercial recording;
  • It is not replaceable with a free-use sample of comparable educational value; and
  • It is believed that this sample will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original recording.

Fair use in Black Flag (band)

Though the picture is subject to copyright I (Peter G Werner 03:16, 2 March 2007 (UTC)) feel it is covered by the U.S. fair use laws because:

  1. it is only a 30-second sample of a much longer track.
  2. it does not limit the copyright owner's rights to sell the CD album in any way;
  3. the sample could not be used to make illegal copies of the album artwork on another CD;
  4. the music sample is significant because it was made by a famous artist, Black Flag, being a notable representation of their sound early in their career.
